Land Subdivsion & Municipal Works

FTS has the capability provide the engineering and layout designs for subdivisions and the aspects needed to be documented vary with each project. These are generally covered under our Civil, Structural and Hydraulic engineering services pages.

In addition to the technical design requirements associated with subdivisions, there are different approvals required than for normal building works projects.

FTS can organise all the relevant applications as part of our Project Management Services, as well as do the design and prepare the required reports.

For instance, in NSW, subdivisions require a DA and then require a Subdivision Works Certificate which is your permit to begin the works. (This is the equivalent to a Construction Certificate for a DA related to Building and Construction works).

The DA for a project may also include Municipal Works and in NSW these require a separate permit from each of the relevant authorities prior to gaining a construction or subdivision work certificate. Examples being power, sewer, water supply, and telecommunications authorities.

Operational works permit

Operational work is defined under the Planning Act 2016 as “work, other than building work or plumbing or drainage work, in, on, over or under premises that materially affects premises or the use of a premises.” In general, Operational Work permit is required for filling and excavation, road works, stormwater drainage (not house drainage), vegetation management

and/or rehabilitation, footpath works and other infrastructure. Also, if the development requires water and sewer reticulation, electricity and telecommunication supply, then permits are required from the relevant service authorities such as Main Roads Authority, Mines Subsidence Authority etc.. (Operational work approval is usually required for any works conditioned under a Reconfiguring of Lot (RoL) approval).

“Reconfiguring of Lot” is the term used in Queensland as the equivalent of “Subdivisions” in NSW.

In Queensland, the DA for a project may also include conditions related to obtaining other compliance permits such as Operational Works permits. A separate application is made to the consent authority to obtain required compliance permit. You need to apply for these permits to construct the works. Known as “Assessable development permits” they are required before you can begin the works. Permits that may be required include:

  • Operational Works

  • Reconfiguring of Lot

  • Building Works

  • Plumbing and Drainage Works

  • Material Change of Use of premises

  • Clearing Native Vegetation

  • Demolition of Existing Building

Compliance assessment permit

Compliance assessment is a type of application to comply with conditions of a development approval for a Material Change of Use (MCU) or Building Work (BW) and to obtain a permit to begin work. Usually, it relates to the BCA performance requirements and standard and is required before beginning work. (The equivalent in NSW is a Construction Certificate).
